The Spanish Government opened a public consultation on the transposition of the EU Platform Work Directive on 5 August 2026.
The Labour Ministry aims to have the transposition complete by the end of the year. The idea is to extend the ‘Rider Law’, which established a general legal presumption of employment in the food delivery sector, to all persons performing platform work.
“The transposition of the Directive requires a series of changes in the Spanish labor regulations that would affect matters of different nature, such as the adequate classification of the employment relationship in platforms, the rights related to algorithmic transparency and the rights recognised in the field of personal data protection at work.,” the Ministry of Labour stated.
“On the other hand, the transposition of the Directive must be carried out in a manner that is in accordance with the obligations established in the Convention on Decent Work in the Platform Economy (Convention 193) and without contradicting the regulations already in force on the protection of personal data and artificial intelligence.”
